Terms of Service

1 Acceptance of Terms

By logging into, accessing, or using NFS-Share, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy Policy.

If you are using NFS-Share on behalf of a notarial office or organisation, you represent that you have authority to bind that entity to these terms.

2 Eligibility & Account Registration

NFS-Share is intended exclusively for licensed notarial offices and their authorised staff in Rwanda. Access is granted by a platform administrator upon verification of the subscribing office.

• You must be at least 18 years of age to use the platform
• User accounts are personal and non-transferable
• You are responsible for maintaining the confidentiality of your credentials
• You must notify your office administrator immediately of any unauthorised access

3 Permitted Use

NFS-Share may be used solely for:

• Managing notarial agreements, deeds, and NLA documents
• Creating and managing invoices, receipts, and payments
• Recording and tracking expenses
• Managing client and staff records within your office
• Generating reports and analytics for your office
• Archiving and retrieving notarial documents
• QR code generation and document verification

4 Prohibited Conduct

You must not:

• Access, modify, or delete data belonging to other offices without authorisation
• Attempt to bypass authentication, session controls, or access controls
• Upload malicious files, scripts, or executables
• Use the platform for any purpose that violates Rwandan law
• Reverse-engineer, decompile, or copy any part of the platform software
• Share your credentials with unauthorised individuals
• Enter false, fraudulent, or fabricated notarial records
• Use automated scripts or bots to access the platform

5 Intellectual Property

All software, design, trademarks, and content comprising NFS-Share are the exclusive property of the platform operator and are protected by Rwandan and international intellectual property law.

No licence to copy, redistribute, or create derivative works is granted by these Terms.

6 Data Ownership

All notarial records, client data, and documents you enter into NFS-Share remain the property of the subscribing office (data controller). NFS-Share acts as a data processor under your instruction.

Upon subscription termination, you may request an export of your office's data within 30 days. After that period, data may be purged from active systems (subject to legal retention obligations).

7 Service Availability

We aim to provide 99.5% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be announced in advance. We are not liable for losses arising from temporary unavailability.

8 Subscription & Payment

Subscription fees are agreed at the time of onboarding. Fees are billed on a schedule agreed with your office. Failure to pay may result in service suspension after 15 days' notice.

Fees are non-refundable except where required by Rwandan consumer protection law.

9 Termination

Either party may terminate the subscription with 30 days' written notice. We may terminate immediately if:

• You breach these Terms and fail to remedy the breach within 7 days of notice
• You engage in fraudulent or illegal activity on the platform
• A regulatory authority requires us to suspend your access

10 Limitation of Liability

To the maximum extent permitted by law, NFS-Share's aggregate liability for any claim arising out of these Terms shall not exceed the fees paid in the preceding 12 months.

We are not liable for: loss of profits, indirect or consequential losses, data loss resulting from user error, or losses arising from your non-compliance with these Terms.

11 Governing Law

These Terms are governed by the laws of the Republic of Rwanda. Any dispute shall be subject to the exclusive jurisdiction of the Rwandan courts, with Kigali as the agreed venue.

12 Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or in-platform notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13 Hardware & Devices

Each NFS-Share subscription includes one (1) fingerprint scanner device provided at the time of installation and onboarding. This device is included in the subscription package at no additional cost.

Included and additionally purchased fingerprint scanner devices remain the property of NFS-Share and are provided to the office for use during the active subscription period.

Webcam: A webcam is not provided by NFS-Share. The subscribing office is responsible for purchasing a suitable webcam independently. NFS-Share will assist with installation and configuration at no extra charge.

The subscribing office accepts full responsibility for the safekeeping and proper use of all devices provided by NFS-Share.

Office responsibilities:

• Keep devices in safe custody at all times
• Report any theft or loss to NFS-Share immediately and file a police report
• Pay the full replacement cost for any device that is stolen, lost, or damaged due to misuse or negligence
• Not tamper with, modify, or transfer devices to a third party
• Return devices in good working condition upon subscription termination

NFS-Share responsibilities:

• Provide devices in good working order at the start of subscription
• Replace or repair devices that fail due to normal wear and tear at no cost to the office
• Provide technical support for device setup and connectivity issues
